Terms of Service

1. Acceptance of these terms
By creating an account, accessing, or using Elevations (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. The Service
Elevations is a web application for documenting exterior storm damage on residential and commercial properties, generating adjuster-ready reports, and sharing those reports with third parties via a unique link. The Service is provided “as-is” and may change over time as we add features, fix bugs, and improve performance.
3. Accounts and security
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at hello@elevations.app if you suspect your account has been accessed without authorization.
An organization owner may invite, remove, and manage roles for additional users on their team. Each user is responsible for their own actions within the Service.
4. Acceptable use
You agree not to:
- Use the Service to document property without authorization from the property owner or your engaging client.
- Upload content that infringes intellectual property rights, violates privacy laws, or contains malicious code.
- Attempt to reverse engineer, decompile, or otherwise extract the source code of the Service.
- Use the Service to harass, defraud, or knowingly deceive a third party.
5. Subscriptions, billing, and cancellation
The Service is offered on a paid subscription basis with a free trial. By starting a paid subscription, you authorize us (and our payment processor) to charge the payment method you provide on a recurring basis until you cancel. Cancellation takes effect at the end of the current billing period; we do not provide pro-rated refunds for partial periods unless required by law.
6. Content and intellectual property
You retain ownership of all content you upload to the Service, including photos, annotations, and notes. You grant us a non-exclusive license to store, process, display, and transmit that content solely for the purpose of providing the Service to you.
We retain ownership of the Service itself, including all software, designs, and trademarks. No license to those is granted except as needed for ordinary use of the Service.
7. Third-party services
The Service relies on third-party providers, including but not limited to Supabase (database + storage), Vercel (hosting), and Stripe (payment processing). Your use of the Service is also subject to those providers' terms where applicable. See our Privacy Policy for details on what is shared with whom.
8. Disclaimers
The Service is provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, including (but not limited to) merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that any information you generate using it will be accepted by an insurance adjuster, court, or other party.
9. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or related to these Terms or the Service is limited to the amounts you have paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if continuing to provide the Service to you would expose us to legal or operational risk. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will do so.
11. Governing law
These Terms are governed by the laws of the State of [STATE TO BE CONFIRMED BY COUNSEL], without regard to its conflict-of-law principles. Any disputes will be resolved in the courts located within that state.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via the email associated with your account or a prominent notice on the Service. Your continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms.
